Maine's Paid Family & Medical Leave program began paying benefits May 1, 2026. Employees can take up to 12 weeks of paid leave for medical, family, parental, military, or safe-leave reasons. Worth confirming: you generally can't require staff to burn vacation or sick time first.

Pay transparency is coming (LD 54).

Employers with 10+ employees must list a pay range in job postings. All employers must share a role's pay range with current employees on request and keep pay/position history for employment + 3 years. Takes effect roughly 90 days after the Legislature adjourns — expected late July.

Expanded labor enforcement (LD 1587).

Effective July 14, 2026. The Maine DOL gains subpoena power, can levy bank accounts without a court order, and can stack fines up to $1,000/day for unpaid penalties. Clean records matter more than ever.

Revised drug-testing law.

Effective July 29, 2026. "Probable cause" becomes "reasonable suspicion," arbitrary testing is out, the rehab window shrinks to 12 weeks, and employees can request blood tests. Policies written under the old framework likely need updating.

🌲 Worth Knowing This Month

With PFML benefits now flowing (as of May 1), expect a learning curve as the first employee applications come through. Applications are handled by Aflac via the Maine Paid Leave Portal, and you'll be notified when an employee applies. Now's a good time to make sure your managers know what to do when a leave request lands.
