This report is for any asylum seekers or immigrants that are receiving any benefits from General Assistance.
We have had some in the past who were reported. (Remind me to show you the sheet but do not have any currently).
So, you can send them an email stating that you have none.

Good afternoon,
It’s time to submit your 24-month counts for all those clients who are not considered “Lawfully Present.”
If you have NEVER had an applicant require a monthly count, please reply to this email notifying us of such.
The Report
1. We want to know everyone who received GA in the last fiscal year who was not legally present. You do not need to indicate household composition in any way. Do not include US Born children as they are legally present. 2. All applicants (not just the case head) who have not received lawfully present status, which includes those who have attested to the pursuit of a lawful process but have not yet filed an application for asylum, will fall under the 24 month-count group. 3. Please submit the Alien number, client name, number of months assisted, and the last month assistance was issued. If the client has not yet received an alien number, please submit the DHHS identifying “A number” which is the client’s account number (8 numbers followed by an A or possibly a T). This is the same number used on all Department correspondence and when searching for the client in the GA Portal. 4. Please submit the report as Excel sheet, not.pdf., following the format of the blank template that is attached for your convenience. Any report received not following this format may be rejected. 5. I ask that counts for fiscal year 2025 (July 1, 2024, through June 30, 2025) be submitted to me by Friday, June 26.
The Rules
A person is considered Lawfully Present when the person is a U.S. Citizen or has permanent resident status. Per 45 CFR § 152.2 https://www.ecfr.gov/current/title-45/subtitle-A/subchapter-B/part-155/subpart-A/section-155.20 further explains:
Lawfully present means a noncitizen who—
(1) Is a qualified noncitizen as defined at 42 CFR 435.4 https://www.ecfr.gov/current/title-42/section-435.4;
(2) Is in a valid nonimmigrant status, as defined in 8 U.S.C. 1101(a)(15) https://www.govinfo.gov/link/uscode/8/1101 or otherwise under the immigration laws (as defined in 8 U.S.C. 1101(a)(17) https://www.govinfo.gov/link/uscode/8/1101 );
(3) Is paroled into the United States in accordance with 8 U.S.C. 1182(d)(5) https://www.govinfo.gov/link/uscode/8/1182 for less than 1 year, except for a noncitizen paroled for prosecution, for deferred inspection or pending removal proceedings;
(4) Is granted temporary resident status in accordance with 8 U.S.C. 1160 https://www.govinfo.gov/link/uscode/8/1160 or 1255a https://www.govinfo.gov/link/uscode/8/1255a;
(5) Is granted Temporary Protected Status (TPS) in accordance with 8 U.S.C. 1254a https://www.govinfo.gov/link/uscode/8/1254a;
(6) Is granted employment authorization under 8 CFR 274a.12(c) https://www.ecfr.gov/current/title-8/section-274a.12#p-274a.12(c);
(7) Is a Family Unity beneficiary in accordance with section 301 of Pub. L. 101-649 as amended; or section 1504 of the LIFE Act Amendments of 2000, title XV of H.R. 5666, enacted by reference in Pub. L. 106-554 https://www.govinfo.gov/link/plaw/106/public/554 (see section 1504 of App. D to Pub. L. 106-554 https://www.govinfo.gov/link/plaw/106/public/554 );
(8) Is covered by Deferred Enforced Departure (DED) in accordance with a decision made by the President;
(9) Is granted deferred action, including but not limited to individuals granted deferred action under 8 CFR 236.22 https://www.ecfr.gov/current/title-8/section-236.22;
(10) Has a pending application for adjustment of status;
(11)
(i) Has a pending application for asylum under 8 U.S.C. 1158 https://www.govinfo.gov/link/uscode/8/1158, for withholding of removal under 8 U.S.C. 1231(b)(3)(A) https://www.govinfo.gov/link/uscode/8/1231, or for protection under the regulations implementing the Convention Against Torture; and
(ii) Is under the age of 14;
(12) Has been granted withholding of removal under the regulations implementing the Convention Against Torture; or
(13) Has a pending or approved petition for Special Immigrant Juvenile classification as described in 8 U.S.C. 1101(a)(27)(J) https://www.govinfo.gov/link/uscode/8/1101.
You should be tracking these individuals to determine how many months of assistance they have received. Per M.R.S. 22 § 4301, Section 3, a client who does not meet the guidelines for Lawfully Present shall not receive assistance for more than 24 months.
