I’m forwarding to you Andy Fisk’s response to my questions about the powerhouse. In short, he suggests flexing the town’s authority through its ordinances.

Sorry to miss the meeting. On travel most of the week, so here’s a quick reply.

You have access to American Rivers’ FERC attorney, Kelly Catlett. She’s been doing this for more than 20 years. So she’s available to help directly. There are some FERC angles to the powerhouse question certainly, but that’s not a strong case I’m afraid.

That said, the issue of the powerhouse has a chance of being resolved more favorably through local authorities – either thru land use ordinances, shoreland zoning,or other authorities (performance bonding, etc.) If the town wants to play hardball on the powerhouse I think you need to look at these authorities as much or more than trying to convince FERC on the powerhouse.

I’ll let you know about our meeting schedule as dates and times are confirmed.

I’ll relay to the committee that you recommend the Towns hire a good municipal attorney. What is your reasoning rather than someone familiar with FERC decommissionings? When I’ve suggested it in the past, the Buxton Select Board has been apprehensive about using their municipal attorney beyond the day-to-day legal questions. Cost is the driver. The Hollis Select Board seems to be okay with utilizing their attorney for the decommissioning.

Are there details to share about approaching Brookfield’s investors and institutional investors to provide influence on Brookfield?

Is there someone at American Rivers that can help the committee corroborate some AI research? Renee Lewis has gotten some interesting results about Brookfield Renewable’s sales of energy assets over the past decade, and the risks associated with retention of the powerhouse and some examples of similar situations. I’ve attached her email which includes the results.
