Yup - on the agenda.

Our Town attorney prefers it not be universal (to include employees) claiming parts of it should be added to our (non-existent) personnel policy.

Shouldn’t we get him to adjust the areas of concern and present this once reviewed? It’s been 2+ years….a few more weeks won’t hurt.

I didn't see this on the agenda for tomorrow but to keep it rolling i made a few suggested redlines in the attached word document that i think tightens things up a little. There were also some numbering errors that are fixed in this draft (but the fixes are not redlined)

To summarize, it how has:

1. New override provision (non-Select Board complaints) - If the Town Manager declines to refer a complaint for outside investigation, the full Select Board can vote to refer it anyway, rather than the decision being final.

2. New override provision (Select Board complaints) - Same idea, but for when the Chair or Vice Chair declines to refer a complaint about a Select Board member. The subject of the complaint wouldn't vote on the referral question.

3. 14-day deadline on the referral decision - Right now there's no timeframe for the Town Manager/Chair/Vice Chair to decide whether to refer a complaint. I added a 14-day deadline so that decision can't just sit indefinitely.

4. Fixed the vote-threshold math - The current draft requires "at least four affirmative votes" to find a violation. If more than one member is ever absent or recused, that threshold becomes mathematically impossible to hit. This changed it to "two-thirds of the members entitled to vote on the question," matching the standard already used later in the same section for sanctions.

Please consider these edits before we discuss and vote on implementing it.
