TOWN OF HOLLIS, MAINE ORDINANCE TO CHANGE ELECTED MUNICIPAL OFFICIALS TO APPOINTED TOWN EMPLOYEES Section 1 Authority and Purpose The purpose of this Ordinance is to change the positions of Road Commissioner, Tax Collector, Town Clerk, and Treasurer (hereafter called “Municipal Officials”) from elected officials to appointed Town employees. This Ordinance is enacted pursuant to the authority granted under Title 30-A, Maine Revised Statutes, §2601(1), which allows a municipality to change the method of selection of certain Municipal Officials, from elected to appointed by a Town Manager and confirmed by the Select Board. Section 2 Repeal of Existing Provisions All Ordinances, Policies, Town Meeting Votes, or other municipal rules inconsistent with this Ordinance-including any provision for the election of Municipal Officials-are hereby repealed. Section 3 Creation of Appointed Employees Positions The current positions of Municipal Officials (hereafter called “Appointed Employees”) shall henceforth be a ppointed positions, hired by the Town Manager, subject to confirmation by the Select Board, rather than by popular election. The Appointed Employees shall serve under the supervision and direction of the Town Manager and in accordance with Title 30-A M.R.S. §2636 and the Town of Hollis Ordinance to Establish a Five-Member Select Board/Town Manager Form of Government Section 1.4, personnel policies, and professional standards. The Town Manager may remove the Appointed Employees for cause, consistent with applicable employment contracts, personnel policies, and state law, and report all removals to the Select Board. Section 4. Appointment Procedure When the office of an Appointed Employee becomes vacant due to resignation, removal, death, or otherwise, the Town Manager shall appoint a qualified individual to fill the position. The appointment shall be made following a fair and transparent recruitment process consistent with the Town's personnel policies. The Town Manager shall provide written notice of the appointment to the Select Board, and the appointment shall be recorded in the official town records pursuant to Title 30-A M.R.S. §2526(9). Before assuming the duties of office, an Appointed Employee or deputy shall be sworn by the moderator in open town meeting, by the clerk, or by any other person authorized by law to administer an oath, including a notary public or dedimus justice. Section 5. Qualifications, Term, and Compensation In order to become an Appointed Employee, a person must be a resident of the State of Maine, at least 18 years of age, and a citizen of the United States. Title 30-A M.R.S.§2526(3) The Town Manager shall determine the qualifications, duties, and performance expectations of the Appointed Employees in accordance with state law and professional standards. The Appointed Employees’ compensation, benefits, and other conditions of employment shall be set by the Town Manager, consistent with the municipal budget and personnel policies. The Town Manager may or may not utilize the formation of a Hiring Committee during the hiring process. The Appointed Employees shall serve at the pleasure of the Town Manager until such time when the position becomes vacant and a successor is appointed. Appointed Employees may not serve as Moderator, or be a member of the Select Board, Assessor, member of the School Board, Planning Board, Board of Appeals, or Finance Committee. Section 6. Transition Provisions If the Road Commissioner, Tax Collector, Town Clerk, or Treasurer is serving at the time of the adoption of this Ordinance, that person shall continue to serve until the expiration of their current term. Upon expiration of that term, or upon a vacancy in the office, the Town Manager shall appoint a successor in accordance with this Ordinance. Section 7. Severability If any section, subsection, sentence, clause, or phrase of this Ordinance is held invalid by a court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance, which shall remain in full force and effect. Section 8. Effective Date This ordinance shall become effective on June 8, 2027 following its approval at a Town Meeting and in accordance with Title 30-A M.R.S. §2526(6).
