    Policy #22 Page 1 of 3 Town of Hollis 34 Town Farm Road, Hollis, ME 04042 Phone: (207) 929 - 8552 Fax: (207) 929 - 3686 www.hollismaine.org POLICY # 2 2 PAYROL L & DISBURSEMENT WARR A NTS & TOWN CHARGE ACCOUNTS PAYROLL WARRANTS: All Salaried, Elected, Non - elected, Departmen t Heads and Committee/Board Members. Work hours must entered in the payroll system no later than 11:00 AM each Tuesday. A. All hours actually worked li s ted, using standard t ime. List your beginning and endin g time, and any breaks taken. If you attend a class pertaining t o work, th i s must be listed. List any personal time, vacation, and/ or sick time. B. All system entries must be approved by Departmen t Heads or their designees. Time records for all salaried employees report time off for sick, PTO, vacation or other absence. C. Fire Rescue Departmen t payroll will be listed o n one roster prepared by the Fire Chief or Administrative Assistant and submitted to the Payroll Company. Supporting documentation, time cards and log s h eets listing dates and times of activitie s will remain at the Fire Station. D. The Planning Board, Finance Committee, and Appeal s Board will be paid stipen d s quarterl y, with the last quarter of the year to be requ ested the second week of June to be paid from the current fis cal year. E. When notified by the Payroll Company administrator, the pending payroll will be reviewed by the Town Manager and Treasurer where approval to record will be given. F. P ayroll will be ready for Thursday release. The Select Board will sign the payroll warrant, signifying that the payroll warrant and the related compensation have been reviewed and appr oved. Off - line payroll check s are not recommen d ed and need the express signed ap p roval of the Town Manager.

    Policy #22 Page 2 of 3 DISBURSEMENT WARRANT: A. Requests for payment from the disbur s ement warrant must be received by 10:00 AM on Wednesday in the Treasurer's office. Request s received after 10:00 AM w ill be paid in t h e following week's warrant. All reques t s must be made and signed b y the Departmen t Head or des i gnee as listed on the Purchase Order approval list. The Treasurer will then l ist these request s in a written disbursement warrant for m for the Select B oard to sign off making an official reques t for the di s burseme n t of these funds. The Select Board will review and sign t h ese requests at their public meeting. This d isbursement warrant re q uires the signa t ure of at least three members of the Sel e ct Board. B. Weekly disbursement checks will be issued following the signing. The total of the disbursement checks must total the amount of disbursement s previously signed by the Select Board at their meeting. Checks will be available to be mailed or picked u p on Friday after 12:00PM. C. Off - line checks are not re c ommended f rom the disb u rsement warrant and need the written authoriz a tion of at least two members of the Selec t Board. A copy of the autho r i zed check will be in the following weeks warrant to be signed by the Select Board, verifying app r oval. TOWN CHARGE ACCOUNTS: A) No personal c h arges may be made on Town credit cards. B) Only autho r ized users may charge on the account. Credit cards have been issued to the Treasurer, Department Head of the Recreation Department and the Fire Chief. C) The Town Manager, under Select Board authorization, is authorized to sign contracts and open charge accounts on behalf of the Town of Hollis. D) Receipts must be given to the Trea s urer for all purchase s made with the credit card at least 2 weeks prior to the payment due date of the credit card. E) The subaccoun t to be charged must be listed on the receipt or the statemen t. F ) It is the employee's responsib i lity to underst a nd and fo l low all r equi r ements i n this pol i cy.

    Policy #62 Dru g & Alcohol Policy Page 1 of 2 Town of Hollis 34 Town Farm Road, Hollis, ME 04042 Phone: (207) 929 - 8552 Fax: (207) 929 - 3686 www.hollismaine.org POLICY # 6 2 DRUG AND ALCOHOL POLICY All employees of the Town are not permitted to use, sell, transfer, possess, or be under the influence of alcohol or illegal drugs while on Town premises, on work duty or breaks. Employees are not permitted to use, sell, transfer, possess, or be under the influence of cannabis in any form, or to be under the influence of cannabis, while on Town property, on work duty, and on breaks. An employee may be presumed to be under the influence of cannabis if they have ingested cannabis in any form within two hours of starting work. Furthermore, employees must ensure that their persons and e ffects do not emit the odor of cannabis (or any other illegal drug or alcohol) in the workplace. Any employee using a prescription or over - the - counter medication that could interfere with job safety or job performance must notify their Department Head. That Department Head must also notify the Town Manager. Use of any prescription medication in a manner that impacts employee safety or renders an employee unable to perform the essential functions of the job (with or without reasonable accommodation) is not permitted. Any employee suspected of violating this policy will be promptly removed from their work area and work duties, and the ma tter will be investigated. Any employee who suspects another employee of possessing, using, or being under the influence of alcohol or illegal drugs in violation of this policy are required to immediately report their suspicion to the ir Department Head and the Town Manager, and cooperate in any subsequent investigation. If it is found t hat an employee has violated this Drug and Alcohol policy, that person may be disciplined, up to and including termination. Without waiving their right to discipline or dismissal in a proper case (including, but not limited to, any of the offenses above), the Town recognizes alcohol and drug abuse including the misuse of prescribed drugs may constitute an illness or disability. The Town will mainta in a continuing effort to identify and encourage treatment of drug and alcohol problems of employees. Department Heads will receive instructional material on the identification of alcohol and drug abuse problems. Additionally, the Town may recommend empl oyees utilize the Employee Assistance Program (EAP) available to all employees of the Town.

    Policy #62 Dru g & Alcohol Policy Page 2 of 2 If the employee is covered through the Town’s Health Insurance plan and obtains a diagnosis indicating a drug or alcohol abuse problem or substance use disorder, the Department Head will assist the employee in obtaining a list of treatment resources available to ensure that they are informed of the help available. If an employee undertakes treatment or rehabilitation for a drug or alcohol abuse problem, the Department Head will work with the employee to modify the employee's work schedule or duties, if modification is consistent with the operational need s of the department and as required by law, to allow the employee a reasonable period of treatment. The employee may request leave pursuant to the Federal or State Family and Medical Leave Act ( FMLA ). An employee who has been diagnosed as having a drug or alcohol problem and who has undergone or is undergoing treatment may return to work after being certified by a physician as able to return, pursuant to Section 8 of the Town’s Employment, Illness, Disability and Absence Ordinance. All relevant personnel records and discussions will be kept confidential. If an employee whose conduct the ir Department Head or Town Manager reasonably believes is adversely affected by drug use, including the misuse of prescribed drugs or alcohol abuse, chooses not to obtain a professional diagnosis and/or treatment, the Department Head or Town Manager shall evaluate the employee solely on work performance and take appropriate action under this policy. All Town buildings and the property housed therein are owned by the Town of Hollis. It is the policy of the Town and State law that all property be disposed of through the Town Manager ’ s o ffice and forwarded to the Select Board to handle as a body as the y deem appropriate. 2. The Select Board are the only Town representatives authorized to sell, trade or give away Town owned property from any Town owned facility and must do so under a majority vote at a public meeting. 3. At the discretion of the Select Board items over a certain determined value may be put for public bid when being sold. 4. No Town of Hollis property is to be used for personal use. This practice is not allowed for security and liability reasons. Town of Hollis property includes Town buildings and any items (including but not limited to; machinery, tools, sports equipment, office equipment, computers, etc.) owned by the Town and housed therein. 5. All donations of personal property including monies, grant funds or equipment to the Town of Hollis must be approved and accepted by the Select Board by a majority vote at a public meeting. No other Town Employees or Departments Heads are authorized to accept donations on behalf of the Town of Hollis. As required by Maine State l aw, some donations may need voter approval at a Town meeting to be accepted and utilized by the Town. 6. As voted at the Annu al Town Meeting held on June 16, 2021, t he Select Board, by majority vote at a public meeting, is authorized to dispose, convey, sell or negotiate towards a trade in value deemed by the ma jority of the Select Board in the best interest of the Town, any surp lus, out dated or unusable town owned p ers onal property, exclusive of real estate.     Page 1 of 2 Town of Hollis 34 Town Farm Road, Hollis, ME 04042 Phone: (207) 929 - 8552 Fax: (207) 929 - 3686 www.hollismaine.org POLICY #7 RETURNED CHECK POLICY It shall be the policy of the Town of Hollis not to accept any checks from an individual, company, corporation, etc. that has had a check previously returned within the last 6 (six) months due to insufficient funds. Another check may not be accepted from t he party involved until a waiting period of 6 (six) months from the date in which the check is actually made good has passed. In order to make good on a returned check the party involved must purchase the check from the Town of Hollis with a money order, cashier’s check, debit or credit card, or cash in an amount equal to the amount of the check; the fees assessed to the Town by the Financial Institution, and a return check fee as set by the Select Board in Policy #10: Schedule of Fees. A certified letter will be issued and upon receipt or return of the certified letter from the Town of Hollis, it is the responsibility of the account owner to purchase the check from the Town within 5 (five) working days of receipt of the certified lett er. If the check is not purchased within the five working day period, the department head will take actions deemed appropriate by the Town Manager based upon the nature of the original transaction. The Town of Hollis reserves the right to refuse chec ks from an individual, company or corporation that has habitually negotiated checks that were not honored by a financial institution in the past 24 months. Procedures for administering this policy will be as follows: When a check is received back from the Bank as insufficient funds (ISF), the Treasurer will: 1. Do a direct entry to remove the money from the cash account with the following entries: Credit Cash 0010 for the amount of the check & Bank Fee Debit Bank Fee Acct 0011 for the amount of the Bank Fee Debit ISF Acct 0012 for the amount of the check The check bearers’ name will be listed on the direct entry. A copy of the direct entry post will be put in the Bank reconciliation file. 2. Inform the Department Head of the accounts involved; 3. Send a registered letter to the check bearer of the ISF informing that: a) The check has been returned; b) Total amount due; c) Acceptable forms of payment; and, d) Time frame stated in this policy. 4. Add the parties name to the ISF list to be distributed to all departments.

    Page 2 of 2 5. After five working days notify the Town Manager and the Department Head. When an ISF check is paid, the Treasurer will: 1. Do a direct entry to re - enter the money with the following entries: Debit Cash 0010 for the amount received Credit ISF Acct 0012 for the amount of the ISF Check Credit Bank Fee 0011 for the amount of the Bank Fee Credit REV R0160 for the amount of the Town Fees The check bearers’ name will be listed on the direct entry; 2. Make a copy of the direct entry post and put in the Bank reconciliation file; 3. Make a separate deposit for this transaction and put a copy in the Bank reconciliation file; and, 4. Remove the check bearers’ name from the ISF list and add it to the Six Month Waiting Period portion of the list. This policy may be waived by the Town Manager in the event that written notification is received from the Bank acknowledging that the error was theirs. This Policy shall be effective immediately. Municipal Activities shall take precedence over all others in the use of the facilities. B. No group or individual use will be allowed in the Municipal Fire Stations. C. Groups or individuals requesting use of Municipal F acilities shall complete an “Application for Use of Municipal Facilities. ” D. The Use Committee /Town Manager reviews and determines approval for all requests. E. There are no For - Profit Groups allowed to use Municipal Facilities. F. Non - Profit Groups or individuals will need to sign the “Facilities Use Agreement” and show that they have insurance or obtain event insurance through Gather Guard prior to approval. G. Non - Profit Groups using the Community Building or Town Hall Conference Room will be able to use them during their scheduled business hours. H. Only Hollis residents may reserve the facilities. 2. Building Use Rules A. Smoking is prohibited in all Municipal Buildings and Grounds. B. Alcoholic beverages and/or other drugs shall not be possessed or consumed on Town property. C. The applicant /user is held responsible for the preservation of order. D. The facilities used by the applicant /user will be examined carefully before and after use, and the applicant /user agrees to promptly make good any loss or damage occurring during the ir use of said facilities. E. The right to revoke any facility use at any time is reserved by the Use Committee or the Town Manager. F. Premises are made available with the understanding that tipping of municipal personnel is not permitted. G. No decorations shall be attached to the interior or exterior of the building without prior permission and direction from the Use Committee /Town Manager. USE OF SCOTCH TAPE & TACKS IS FORBIDDEN.

There shall be no tampering or changes of any electrical outlet, fixture s, etc. J. Keys will not be provided to any group member or individual that is not an employee of the Town of Hollis. K. Adult supervision is required at all times. L. The facilit ies are to be left in the condition it is found. All furniture used should be wiped down, floors swept, kitchen and rest room s picked up. M. All trash and recycling should be removed from the premises. 3. Fees A. All groups and individuals will be charged $ 25 per hour for all facilities. Non - P rofit organizations may use rooms for meetings without charge.     Page 4 of 4 FACILITIES USE AGREEMENT 1. The Town of Hollis shall indemnify and hold harmless the USER from claims, suits or liabilities resulting from the negligence of the Town, its officers, agents and employees. The USER shall indemnify and hold harmless the Town of Hollis, its officers, agents and employees from claims, suits or liabilities resulting from the negligence of the USER. 2. The USER shall hold harmless, indemnify and defend the Town of Hollis against liabilities, expenses and losses imposed upon them as a result of the negligent actions or inaction of the USER related to its use or operation of the premises. The Town of Hollis shall hold harmless, indemnify and defend the USER against liabilities, expenses and losses imposed upon them as a result of the actions or inaction of the Town’s employees, officers or agents related to its ownership of the Premises. This obligation to i ndemnify shall not waive any defense immunity or limitation of liability, which may be available to the USER, under the Maine Tort Claims Act pursuant to the provisions of 14 MRSA Section 8101 et seq. or any other privileges or immunities as may be provide d by law. 3. The USER shall provide a Certificate of Insurance naming the Town of Hollis as an Additional Insured. 4. Smoking shall not be permitted in any Municipal Building. 5. Alcoholic beverages shall not be permitted. 6. The USER is held responsible for the preservation of order. The Use Committee/Town Manager may require the presence of a Police Officer for any activity they deem appropriate. Payment of the officers shall be the responsibility of the USER and is in addition to any municipal fee. 7. The facility used will be examined after use. The USER agrees to pay for cleaning or damages occurring during the use of the facility or if the facility is not left in the condition it was found. 8. The right to revoke any building or property use at any time is reserved by the Use Committee/Town Manager. 10. No decorations shall be attached to the building without prior permission and direction from the Committee (use of tacks or scotch tape is not allowed). 11. Any equipment, pictures, posters, etc. that may be in the building shall not be removed or rearranged. 12. There shall be no tampering or changes of any electrical outlet, fixtures, etc. 13.     TOWN OF HOLLIS, MAINE ORDINANCE NO. _____ AN ORDINANCE PROHIBITING LARGE-SCALE E-COMMERCE DISTRIBUTION AND FULFILLMENT CENTERS IN THE TOWN OF HOLLIS, MAINE Section 1. Purpose and Intent The Town of Hollis finds that large-scale e-commerce distribution and fulfillment centers may create substantial adverse impacts on the Town’s rural character, traffic conditions, road infrastructure, noise environment, public safety services, stormwater systems, and overall public welfare.

    The Town further finds that such facilities may generate high volumes of truck traffic, round-the-clock industrial activity, warehouse development pressure, and land use conflicts incompatible with the Town’s existing residential and rural nature.

    The purpose of this Ordinance is to preserve the rural and residential character of Hollis, protect municipal infrastructure and natural resources, and prevent incompatible industrial-scale warehouse and fulfillment operations from locating within the Town.

    This Ordinance is adopted pursuant to the Town’s home rule and land use authority under the laws of the State of Maine. Section 2. Definitions A. “Distribution Center” A building, structure, or facility used primarily for the receipt, storage, sorting, packaging, redistribution, shipment, or delivery of goods, products, or merchandise.

    B. “E-Commerce Fulfillment Center” A Distribution Center used primarily to fulfill online retail orders, including facilities engaged in warehousing, packaging, sorting, dispatching, or delivery logistics for internet-based commerce.

    C. “Large-Scale Distribution or Fulfillment Center” Any Distribution Center or E-Commerce Fulfillment Center that: 1. occupies more than two thousand (2,000) square feet of gross floor area; or 2. generates regular commercial truck traffic associated with regional or national distribution operations; or 3. operates as part of a regional, national, or international logistics network.

    D. “Accessory Storage Use” Incidental storage or shipping areas accessory to a lawful principal business use, including ordinary retail back rooms, agricultural storage, municipal facilities, or small local businesses not operated as standalone warehouse or fulfillment operations. Section 3. Prohibited Uses A. Large-Scale Distribution or Fulfillment Centers are prohibited in all zoning districts within the Town of Hollis.

    B. No person, corporation, limited liability company, partnership, trust, or other entity shall: 1. establish, 2. construct, 3. expand, 4. operate, or 5. substantially modify any Large-Scale Distribution or Fulfillment Center within the Town.

    C. This prohibition includes, but is not limited to, facilities operated for large-scale online retail distribution, package fulfillment, regional logistics operations, or similar warehouse-based delivery systems. Section 4. Exemptions This Ordinance shall not apply to: 1. Accessory Storage Uses incidental to an otherwise lawful principal use; 2. Agricultural storage buildings and farm supply facilities; 3. Municipal or public safety storage facilities; 4. Small local businesses occupying 2,000 square feet or less; 5. Retail establishments with ordinary onsite inventory storage accessory to retail sales. Section 5. Nonconforming Uses Any Large-Scale Distribution or Fulfillment Center lawfully operating prior to the effective date of this Ordinance may continue as a lawful nonconforming use, provided that: 1. the use shall not expand beyond its existing footprint or operational capacity; 2. no additional warehouse space or truck loading infrastructure shall be added; and 3. if discontinued for a period exceeding twelve (12) consecutive months, the nonconforming status shall terminate. Section 6. Administration and Enforcement A. No permit, site plan approval, occupancy permit, or other municipal approval shall be issued for any use prohibited under this Ordinance.

    B. The Code Enforcement Officer of the Town of Hollis is authorized to enforce this Ordinance.

    C. Any violation of this Ordinance shall constitute a land use violation subject to: 1. fines of not less than $500 per day per violation; 2. injunctive relief; 3. removal orders; and 4. recovery of municipal enforcement costs and attorney’s fees as permitted by Maine law. Section 7. Severability Should any section or provision of this Ordinance be declared invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. Section 8. Effective Date This Ordinance shall take effect immediately upon adoption by the Town of Hollis in accordance with Maine law and Town procedures.

Purpose and Intent The Town of Hollis finds that large-scale data centers may impose substantial impacts on the Town’s rural character, electrical infrastructure, water resources, land use patterns, noise environment, emergency services, and overall public welfare.

    The purpose of this Ordinance is to preserve the rural and residential nature of the Town, protect municipal infrastructure and natural resources, and prevent incompatible industrial-scale computing facilities from locating within the Town.

    This Ordinance is adopted pursuant to the Town’s home rule and land use authority under the laws of the State of Maine. Section 2. Definitions A. “Data Center” A building, structure, facility, or group of facilities used primarily for the storage, processing, management, transmission, cryptocurrency mining, artificial intelligence computation, hosting, or distribution of digital data through networked computer servers.

    B. “Large-Scale Data Center” A Data Center that: 1. occupies more than two thousand (2,000) square feet of gross floor area; or 2. is designed for commercial colocation, cloud computing, hyperscale computing, artificial intelligence model training or inference, or cryptocurrency mining operations.

    C. “Accessory Server Use” A server room or information technology equipment accessory and incidental to a permitted principal use, including ordinary business, municipal, educational, agricultural, retail, medical, or home office operations, provided such use is not operated as a standalone commercial data center. Section 3. Prohibited Uses A. Large-Scale Data Centers are prohibited in all zoning districts within the Town of Hollis.

    B. No person, corporation, limited liability company, partnership, trust, or other entity shall: 1. establish, 2. construct, 3. expand, 4. operate, or 5. substantially modify a Large-Scale Data Center within the Town.

    C. Commercial cryptocurrency mining operations are expressly prohibited under this Ordinance. Section 4. Exemptions This Ordinance shall not apply to: 1. Accessory Server Uses incidental to an otherwise lawful principal use; 2. Municipal or public safety communications infrastructure; 3. Utility substations or telecommunications facilities otherwise permitted under Town ordinance; 4. Small-scale business or institutional server rooms occupying 2,000 square feet or less. Section 5. Nonconforming Uses Any Large-Scale Data Center lawfully operating prior to the effective date of this Ordinance may continue as a lawful nonconforming use, provided that: 1. the use shall not expand beyond its existing footprint or operational capacity; 2. no additional structures or server capacity shall be added; 3. if discontinued for a period exceeding twelve (12) consecutive months, the nonconforming status shall terminate.
